Notbly Terms of Service

§ 1. General Provisions

1.1. These Terms of Service define the rules for using the Notbly website, available at notbly.com, hereinafter referred to as the "Service".

1.2. The Terms of Service are available free of charge on the Service in a form that allows downloading, recording, and printing.

1.3. Using the Service is tantamount to accepting these Terms of Service.

§ 2. Definitions

Terms used in the Terms of Service mean:

  • User – a natural person, legal person, or organizational unit without legal personality using the Service;
  • Account – an individual User account in the Service, enabling access to the Service's features;
  • Premium Service – a paid service offered in the Service, providing extended access to functionality;
  • Quiz – an interactive test generated by the AI system based on data entered by the User;
  • CV Analysis – an automatic curriculum vitae analysis service using AI technology;
  • Interview Simulation – an interactive job interview simulation using artificial intelligence.

§ 3. Terms of Service Use

3.1. Using the basic features of the Service is free and does not require registration.

3.2. Access to the full functionality of the Service requires creating an Account.

3.3. The conditions for creating an Account are:

  • having full legal capacity;
  • providing a valid email address;
  • acceptance of these Terms of Service;
  • consent to the processing of personal data in accordance with the Privacy Policy.

3.4. The User undertakes to:

  • provide true and current data during registration;
  • keep the Account access password confidential;
  • not transfer Account access to third parties;
  • use the Service in accordance with the law and principles of social coexistence.

§ 4. Types and Scope of Services

4.1. Free services:

  • access to 3 free quizzes;
  • basic Service functionality;
  • access to educational content.

4.2. Premium Services:

  • access to 65 quizzes (Pro plan) or 100 quizzes (Premium plan);
  • unlimited CV optimization;
  • job interview simulations;
  • job offer analysis from URL;
  • STAR methodology in CV;
  • priority support (Premium plan).

4.3. The Administrator reserves the right to modify the scope of services while maintaining the rights acquired by Users.

§ 5. Payments and Subscriptions

5.1. Prices for Premium services are expressed in Polish zloty (PLN) and include VAT.

5.2. Payments are processed through the Stripe payment operator.

5.3. Access to Premium services is activated after the payment is posted.

5.4. Premium services are available for a period of 30 days from the activation date.

5.5. The Administrator does not refund funds for unused quizzes or access time, unless this results from the Administrator's fault.

§ 6. Right of Withdrawal

6.1. The consumer has the right to withdraw from the contract within 14 days without giving a reason.

6.2. The period for withdrawal from the contract begins on the day the contract is concluded.

6.3. The right of withdrawal does not apply in the case of:

  • services fully performed with the express consent of the consumer before the expiry of the withdrawal period;
  • digital content delivered in full, if the performance began with the express consent of the consumer.

§ 7. Intellectual Property

7.1. All materials, including content, graphics, logos, user interface, and the Service's source code, are protected by copyright and are the property of the Administrator.

7.2. Copying, modifying, distributing, or using materials from the Service without the written consent of the Administrator is prohibited.

7.3. Content generated by AI (quizzes, analyses, simulations) is made available to the User for personal use only.

§ 8. Personal Data Protection

8.1. The Administrator processes Users' personal data in accordance with applicable law, in particular with GDPR.

8.2. Detailed information regarding the processing of personal data is contained in the Privacy Policy.

8.3. The User has the right to access their data, rectify it, delete it, limit processing, and transfer it.

§ 9. Liability

9.1. The Administrator makes every effort to ensure the Service operates correctly, but does not guarantee uninterrupted access to the Service.

9.2. The Administrator is not liable for:

  • decisions made by the User based on content generated by AI;
  • damages resulting from improper use of the Service;
  • temporary unavailability of the Service due to technical reasons;
  • actions of third parties, including cyberattacks.

9.3. Content generated by AI is educational and supportive in nature. The Administrator does not guarantee its effectiveness in the recruitment process.

§ 10. Prohibition of Abuse

10.1. The following are prohibited:

  • taking actions that may disrupt the functioning of the Service;
  • attempting unauthorized access to the Service's systems;
  • using the Service for illegal purposes;
  • creating multiple accounts to circumvent free service limits;
  • automatically downloading content from the Service (web scraping).

10.2. In case of violation of the above rules, the Administrator reserves the right to block the Account without refund.

§ 11. Complaints

11.1. Complaints regarding the operation of the Service should be submitted to: lukasz.derwisz11@gmail.com

11.2. The complaint should include:

  • the User's first name, last name, and email address;
  • description of the problem;
  • date of the problem occurrence;
  • expected method of complaint resolution.

11.3. The Administrator considers complaints within 14 days from the date of receipt.

§ 12. Changes to Terms of Service

12.1. The Administrator reserves the right to make changes to the Terms of Service.

12.2. Users will be informed of changes to the Terms of Service at least 7 days before the changes take effect.

12.3. Continuing to use the Service after the changes take effect means acceptance of the new Terms of Service.

§ 13. Final Provisions

13.1. In matters not regulated in these Terms of Service, Polish law applies.

13.2. Disputes arising from the use of the Service will be resolved by common courts having jurisdiction over the Administrator's seat.

13.3. The consumer has the right to use out-of-court methods of complaint resolution and claim pursuit. EU consumers may use the European Commission's Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr.
